General Terms
1. Registration and Acceptance
By registering for Balboa On The River, you acknowledge and accept all the Terms and Conditions outlined in this document, including the Code of Conduct, Media Consent, Liability Waiver, and Respect of Property Agreement.
2. Order Acceptance and Changes
We reserve the right to refuse any order placed with us without justification. If an order must be changed or cancelled, we will make reasonable efforts to notify you using the email provided during registration.
3. Assumption of Risk
All participants join festival classes and activities at their own risk, acknowledging the physically demanding nature of dance. Participants are responsible for their own well-being and must behave in ways that do not endanger others.
4. Participant Liability
Balboa On The River is an event intended for adults. Participants must be at least 18 years old to attend any part of the festival, including classes, parties, and all on-site activities.
Participants are solely responsible for any direct or indirect damages caused during the event. Balboa On The River is not liable for theft, loss, or damage (including personal belongings and equipment), regardless of location (e.g., classes, venues, rooms).
5. Force Majeure
Balboa On The River cannot be held responsible for events beyond its control—such as strikes, cancelled flights, illness of instructors, extreme weather, or other unforeseen circumstances. We will communicate any related changes promptly and do our best to maintain a high-quality experience for all participants.
6. Health, Safety, and Valuables
Organizers and teachers are not responsible for participants’ health, injuries, or personal belongings. Participants should take measures to protect their safety and valuables at all times.
7. Privacy Policy
Accurate personal information must be provided during registration. This data may be used to deliver event services in accordance with our Privacy Policy.
8. Behaviour and Respect
By registering for Balboa On The River, you consent to respecting our Code of Conduct.
Participants are expected to maintain respectful behaviour toward other dancers, teachers, organizers, volunteers, and staff, fostering a safe, inclusive, and friendly environment.
Harassment, discrimination, intimidation, violence, or any kind of criminal or disruptive behaviour will not be tolerated.
Violation may result in warnings, removal from the event without refund, and exclusion from future events.
The Code of Conduct is an integral part of the present Terms and Conditions. By agreeing to these Terms and Conditions, you are also agreeing to respect our Code of Conduct.
9. Respect of Property
By registering, you agree to respect all venues, equipment, and property used during the event. This includes:
- Keeping shared spaces clean
- Wearing appropriate dance shoes that do not damage floors
- Handling furniture, fixtures, and materials responsibly
Participants will be financially liable for any damages they cause.
Media & Recording Policies
10. Photography and Recording in Classes
Recording (video, audio, or photos) during classes is prohibited unless explicit permission is given by the teachers.
11. Media Sharing & Canadian Privacy Law
You must obtain explicit consent before sharing photos or videos containing other participants. Under Canadian privacy laws, individuals photographed or recorded in a private event may request removal of content they find objectionable.
12. Media Consent
By registering for Balboa On The River, you grant the organization full rights to use photographs and videos taken of you during the event for marketing or promotional purposes (including but not limited to our website, social media, and print materials).
If you prefer not to be photographed, please notify us in advance so we can reasonably accommodate your request.
Liability & Health Declarations
13. Health and Medical Information
Participants are responsible for ensuring that they are physically able to participate in the event. By registering, you certify that no qualified health professional has advised you against participating and that no current health condition prevents your involvement.
Please notify organizers of any medical concerns so reasonable accommodations can be considered.
14. Liability Waiver
By registering for Balboa On The River, you agree to the following:
- You participate voluntarily and at your own risk.
- You release the organizers, volunteers, and partners from all liability, including negligence, for any injury, loss, disability, theft, or damages that may occur during travel to/from the event or during participation.
- You agree not to pursue legal claims against Balboa On The River or its organizers for any incident arising from your participation.
15. Insurance
Participants are strongly encouraged to obtain personal health and travel insurance, as organizers are not responsible for medical expenses, injuries, or accidents occurring during the festival.
Event Operations
16. Wristband Policy
All participants will receive a wristband that must be worn at all times to access classes and parties. Lost or damaged wristbands must be reported immediately.
17. Food
When food is provided, we cannot guarantee accommodation of all dietary needs. Participants with specific requirements should plan accordingly and inform us in advance.
18. Schedule or Instructor Changes
The schedule, venue, instructors, and other aspects of the event may change without prior notice. All changes will be communicated as soon as possible. Such changes have no bearing on the cancellation policy set out below.
19. Alcohol and Drug Policy
Participants must comply with all Canadian and Ontario laws regarding alcohol and drug use.
- Alcohol: The legal drinking age in Ontario is 19 years old. Participants under the age of 19 are strictly prohibited from purchasing, consuming, or possessing alcohol at the event or at any associated venue.
- Drugs: The use, possession, or distribution of illegal drugs is strictly prohibited on-site, including all hotel spaces, rooms, hallways, event venues, and any other locations used for the festival.
- Cannabis: Although legal in Canada, cannabis use or smoking is not permitted inside the hotel or event venues, in accordance with hotel policies and provincial regulations.
Any violation of this policy may result in immediate removal from the event without refund.
Cancellation Policy
1. Participant Cancellations
All payments are non-refundable, even if only a first installment was made.
2. Injury-Related Cancellation
If you are injured and unable to participate for this reason, contact us before August 15th with a doctor’s note to receive a full refund, or to transfer your registration to the following year.
3. Ticket Transfers
Ticket transfers require approval from Balboa On The River.
Email us with your intention to transfer, cc’ing the intended buyer.
After approval, the buyer must register, but will not need to submit payment.
Transfers cannot be made after August 4th due to room-sharing logistics.
4. Organizer-Initiated Cancellation
If Balboa On The River must cancel the event, participants will receive a 100% refund.
